Welcome to KaCha (the "Service"), provided by ka-cha ("we", "us"). By using the Service you agree to these Terms.

1. The Service

KaCha is a mobile game: players compare two photographs to find the differences, and on completion receive a serial-numbered limited collectible card. Players may also act as creators and upload photos to build levels. Actual features are as described in the App. We may adjust or update the Service for operational reasons; significant changes will be announced.

2. Accounts

  1. Sign-in is via Apple or Google only. There is no guest mode.
  2. You are responsible for keeping your account secure.
  3. You may delete your account in the App or at https://ka-cha.cc/account-deletion. Deletion is irreversible — see §8 of the Privacy Policy.

3. Player name and the name printed on cards

  1. Your player name is public. It appears on leaderboards, on levels you publish, and on the collectible cards you obtain.
  2. The name is burned into the card image when the card is issued and cannot be changed or removed afterwards, even if you later rename or delete your account. Choose it deliberately.
  3. Names must not infringe others' rights, impersonate anyone, or contain unlawful, discriminatory or obscene content. We may require a change, void issued cards, or suspend the account.

4. User-generated content (photos and levels)

  1. You warrant that you hold the rights to the photos you upload and that they infringe no third party's copyright, likeness, privacy or other rights.
  2. You grant us the licence needed to provide, promote and display the Service: to reproduce, adapt (for example to generate the comparison image), and publicly transmit your content. You retain copyright in your content. If you delete a level or your account we stop displaying it publicly, except for card images already issued under §3.
  3. Every level is reviewed by a person before it goes live and can be reported afterwards. Confirmed violations may result in removal of the level, voiding of the corresponding cards, and suspension of the account.
  4. Do not upload recognizable faces, license plates, addresses or identity documents belonging to others.

5. Purchases, virtual items and refunds

  1. The Service offers in-app purchases (gems and items). Virtual items are for use within the Service only, cannot be exchanged for cash, and have no monetary value.
  2. Purchases are processed by the App Store / Google Play and refunds follow each platform's policy. Consumers in Taiwan additionally have the rights granted by the standard-form contract regulations for online game services, including refund of unused paid points on termination.
  3. Clawback after a refund: if you obtain a refund for a purchase, we may reclaim the gems granted for it. Where your balance is insufficient, the shortfall is recorded as an outstanding amount and settled in instalments from your next purchase. We notify you in-app at the moment of the clawback, stating both the amount deducted and the amount outstanding.
  4. If the Service is discontinued we will give at least 30 days' notice, and unused paid points will be handled as above.

6. Creator earnings

  1. Creators may earn from their levels under the operating rules published in the Service, and may request payout subject to the published threshold and process. Requests are reviewed by a person.
  2. Calculation, revenue share and thresholds may change for operational reasons, with advance notice.
  3. Earnings obtained improperly (for example self-farming, or uploading infringing content) may be withheld or reclaimed.

7. Acceptable use

You must not: undermine fairness through cheats, modified clients or automation; use multiple accounts to evade limits or farm scarce cards; harass other users; upload unlawful or infringing content; or reverse-engineer the Service (except where the law permits). We may suspend or terminate the Service and void cards and earnings obtained in violation.

8. Intellectual property

The Service's software, artwork, music and other content belong to us or our licensors. Rights in user-uploaded content are addressed in §4.

9. Disclaimer and limitation of liability

The Service is provided "as is". Except for our wilful misconduct or gross negligence, we are not liable for damages. Where the law provides mandatory protections, those prevail — nothing here excludes liability that cannot be excluded in advance by law.

10. Changes and termination

We may revise these Terms and announce them in the App or on our website; continued use after the announcement constitutes acceptance.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of China (Taiwan). Disputes shall be submitted to the Taiwan Taipei District Court as the court of first instance, unless the law provides otherwise. Consumer disputes may also be raised with local consumer service centres under the Consumer Protection Act.
